Shipping

Free shipping across the lower 48 states across the USA.

Our shipping options are limited to where FedEx, DHL or CouriersPlease can deliver DG (Dangerous Goods), which is required for the transport of batteries. They don’t have the DG capability at every location.

There may also be restrictions to deliver Dangerous Goods (battery -ies) to remote areas, outlying territories and most islands without road connection to the mainland. Furthermore, DG can’t be shipped to P.O. Boxes or APO/FPO address.

Lithium batteries over certain capacity are classified as Dangerous Goods (DG) and must be shipped by a special service. Such shipments involve DG declaration, strict labelling requirements, use of laboratory tested packaging to the UN specification, and most importantly, special handling at each touchpoint (driver, hub, airport, airplane, etc.) by properly trained staff.

Some of the shipments must be shipped by cargo planes (as opposed to bellyhold of passenger planes), such as when you purchase spare battery (-ies) with your new AirBuddy or a stand-alone spare battery (-ies) later.

There is a fixed surcharge per shipment which increases the shipping costs. The DG surcharge is however charged only once per shipment, not per box. So, if you order multiple AirBuddies (or multiple batteries) at once, you only pay the surcharge once.

We ship directly from our factory in Sydney, Australia by FedEx IP or DHL Express, which usually takes about 5 – 10 days

The customs charges (VAT and duty) vary from country to country. The customs legislation tends to be quite complex. Every country (or even state) has different tax rates, free trade agreements, schedules, exceptions, etc. You can use websites such as Simply Duty to estimate the tax and duty charges. We use the HS code 9506.29 – “Water-skis, surf boards, and other water sport equipment (o/than sailboards) and parts & accessories thereof nesoi”. Please speak to the customs office or a customs broker in your country if you need further assistance.

In practice, the courier companies (FedEx or DHL) or their partners will lodge the customs clearance on your behalf. They will contact you if they require any further information and/or to facilitate your payment of the customs charges. Please make sure that you will be available on the phone number and email address provided during the checkout and react swiftly.

In-stock items are typically processed in 2-4 business days to allow for final testing, product registration, pack-to-order and shipment declaration. If there is an unexpected delay or if any item is on back order, we will email you to let you know.

Neither of the courier companies that we use (DHL, FedEx and CouriersPlease) guarantees any delivery date, so don’t we. Please make your purchase well in time, especially when you need AirBuddy for your upcoming vacation, plan to move house, sail away, etc. Below table shows typical shipping times based on our historical data of AirBuddy shipments – from pick-up at our factory until delivery to the receiver (incl. customs clearance where required). On rare occasions, delays beyond these timeframes may occur. Once a shipment has been picked up by the courier, it’s no longer in our control and it can’t be called off under any circumstances.

Damaged, Lost or Stolen Shipments

We will share with you the tracking number(s) once your AirBuddy has been shipped. Inspect the shipment on delivery before signing the receipt. Should the package be damaged, raise the issue with the courier and notify us at info@thrillseekergear.com. Open the package and thoroughly inspect the product for damage, defects or missing items as soon as possible. If you do not notify us of any damage, defect or missing items within 5 working days of the shipment receipt, we will assume that the shipment arrived without any damage, defect or missing items.

We are NOT responsible for damaged, lost or stolen items due to any parcel service faults. We will do our best to assist resolving the issue with the courier, but cannot make any warranties.

Returns and Refunds

We value your trust and want you to be happy with your purchase of AirBuddy. If you are not satisfied with your order, we will try to find a solution to change that. Please note however that shipping of lithium batteries is subject to strict international regulations and requires the use of special shipping service for Dangerous Goods and shipper’s knowledge of how to properly pack, label and document the parcel. This may make the return of the battery(-ies) impossible, too complicated or cost prohibitive.

Orders which have not been shipped yet can usually be cancelled without any penalties, except for costs incurred by third parties, such as payment fees and potential loss arsing from currency exchange. Please contact us for instructions and details.

Received orders which are unopened, in its original, undamaged packaging and sealed may be returned for a refund or store credit less a 15% restocking fee, shipping costs, customs fees, duty or tax on import into Australia (if any), any costs incurred by third parties such as payment fees and potential loss arising from currency exchange. You must contact us by email within 30 days from order delivery and request return authorization.

Used products, damaged products, products on sale, discontinued products or products delivered more than 30 days ago will NOT be accepted for return and refunded.

All returns must be properly packed in their original packaging and marked RETURNED GOODS. Return shipping must by organized and paid by the customer. If the return shipment contains battery(-ies), it must be shipped by appropriate service, packed, labelled and declared in accordance with the regulations for shipment of fully- regulated Dangerous Goods. We encourage you to use a courier service with tracking number and insure the parcel. We do not take any liability for loss or damage of the products during the transport. Once we receive and inspect the return shipment, we will notify you of the inspection outcome by email. If your return is approved, we will process a refund to your credit card or the original method of payment. If your return is rejected, you must collect the item within 30 days or we may dispose of it.

Warranty

LIMITED WARRANTY

OXY Pty Ltd warrants, to the original purchaser only, that the AirBuddy product(s) purchased will be free of defects in materials and/or craftsmanship for a Warranty Period of one year* from the date of purchase (delivery date for online orders) under normal use and with proper maintenance as prescribed by AirBuddy’s published product materials, including, but not limited to, user manuals, safety instructions, specifications and service communications.

Depending on the country, particular and variable warranties may apply in relation to applicable legislation. Nothing in this Warranty Policy can exclude or limit these statutory provisions.

To the extent permitted by national laws, the Warranty Period will not be extended, renewed or otherwise affected due to subsequent resale, repair or replacement of the product. However, part(s) replaced during the Warranty Period will be warranted for a new Warranty Period of one year*, provided such replacement has been performed by AirBuddy representative.

Your rights, as purchaser, against OXY Pty Ltd under this Warranty are limited to the repair and replacement of any defective components. OXY Pty Ltd’s maximum liability under this Warranty will not exceed the original purchase price of the defective unit, and OXY Pty Ltd reserves the right at its sole discretion, to refund the purchase price in lieu of repair or replacement.

Shipping charges relating to warranty claims are at the expense of the purchaser unless otherwise agreed in writing with OXY Pty Ltd.

By using your AirBuddy product(s), you agree to be bound by this Warranty Policy. If you are not eligible or do not agree to any of the Terms, do not use your AirBuddy product(s).

CONDITIONS AND RESTRICTIONS

1. This Limited Warranty does not cover:

• Normal wear and tear of the Product.
• Damage from accident, abuse, neglect and/or tampering.
• Damage caused by lack of proper care and maintenance and/or improper periodic servicing.
• Damage caused by an inappropriate mounting or assembly of the Product.
• Damage caused by reliability or compatibility issues when using unauthorized third-party parts.
• Damage caused by any third-party products.
• Damage caused by unauthorized modifications and repair.
• Damage caused by diving that did not follow instruction manual recommendations.
• Damage caused by operation in bad weather (e.g., storms, strong currents, rolling waves, etc.).
• Damage (incl. corrosion) caused by ingress of water.
• Damage caused by mismatch or misuse of the battery and charger.
• Damage caused by operating the unit with a low-charged or defective battery.
• Damage caused by the transportation, handling or storage of the Product.
• Damage caused by a forced diving when components have aged or been damaged.

2. This Limited Warranty is not enforceable if:

• The Product serial number has been removed, deleted, altered or made illegible.
• The Product has been modified or repaired by any person or entity other than AirBuddy representative.
• The Product has been repaired with unauthorized spare parts.

WARRANTY ENFORCEMENT

AirBuddy or its authorized retailer shall at its sole discretion either (a) repair the Product or (b) replace the Product at no charge (excluding shipping and handling charges). The appropriate remedy will be determined by AirBuddy based upon the following considerations:

(a) the value of the Product with no Defect,

(b) the significance of the Defect,

(c) the inconvenience each remedy would place on the original purchaser.

HOW TO OBTAIN WARRANTY SERVICE

If a product does not function as warranted during the warranty period, please check the troubleshooting section of the user manual. If this does not help, please contact customer support at info@thrillseekergear.com. You will need to provide a valid proof-of-purchase, receipt or order number for the warranty service.

AirBuddy will attempt to diagnose and resolve your problem by telephone, e-mail or online chat. If your problem cannot be resolved, you may be required to deliver the product to AirBuddy for further examination. AirBuddy will arrange for repair or replacement service at no cost excluding shipping and handling charges if the problem falls under this Limited Warranty.

Charges may apply for services not covered by this Limited Warranty. Please contact AirBuddy for information specific to your location. The warranty service is only available in the respective regions where you purchased your AirBuddy product.

DISCLAIMER AND LIMITATION OF LIABILITY

WHEN RECEIVING SERVICE, AIRBUDDY IS RESPONSIBLE FOR LOSS OR DAMAGE TO YOUR PRODUCT ONLY WHILE IT IS IN AIRBUDDY’S POSSESSION, NOT IN TRANSIT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS LIMITED WARRANTY IS YOUR SOLE AND EXCLUSIVE REMEDY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED. OXY PTY LTD SHALL NOT BE LIABLE FOR SPECIAL, INCIDENTIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF ANTICIPATED BENEFITS, LOSS OF USE, LOSS OF REVENUE, COST OF ANY STUBSTITUTE EQUIPMENT OR FACILITIES, CLAIMS OF THIRD PARTIES, DAMAGE TO PROPERTY RESULTING FROM THE PURCHASE OR USE OF THE PRODUCT OR ARISING FROM THE BREACH OF THE WARRANTY, BREACH OF

CONTRACT, NEGLIGENCE, STRICT TORT, OR ANY LEGAL OR EQUITABLE THEORY, EVEN IF OXY PTY LTD KNEW OF THE LIKELIHOOD OF SUCH DAMAGES. OXY PTY LTD SHALL NOT BE LIABLE FOR DELAY IN RENDERING WARRANTY SERVICE.

This package is suitable for a single diver. Dive up to 12m (40ft) deep to discover amazing underwater life!
